Steven Hopkins discusses the regime of Prior Approval of Permitted Development rights and the associated limitations and conditions that may apply. The webcast focuses on a number of issues that have received recent judicial attention in the Courts providing welcome clarification on the application of parts of the Prior Approval Regime.
Steven discusses maters concerning planning authorities’ failure to determine, issues concerning extensions to determination periods, as well as the relationship between prior approval consent and relevant classes of permitted development.

Michael Harman discusses Certificates of Lawfulness referencing a number of cases but focusing upon three critical decisions. In his first webcast, Michael focuses on discussing immunity periods, their application and complexities surrounding the issue of ‘contentious’ breaches in particular, citing a number of recent Court decisions.
In his second webcast, still covering Certificates of Lawfulness, Michael focuses on the legal nature of the right that arises and the powers of a Local Planning Authority to revoke a Certificate.

Sarah Hare discusses three important High Court cases focusing on interpretation, variation and negotiation of S106 planning obligations. Sarah’s webcast uses one of Holmes & Hills’ own cases to discuss the High Court’s approach to the interpretation of S106 disputes. Sarah references another regional case to discuss the issue of variations and Section 73 permissions.
On negotiation, Sarah references a Court of Appeal case to discuss the relationship between Planning Committees’ resolutions to grant, officers’ reports and the scope of Members’ delegation of negotiations.
