Unfair dismissal and statutory redundancy payments to increase

The Employment Rights (Increase of Limits) Order 2011 has been published and changes to Employment Law coming into force on 1 February 2012 include an increase in the maximum amount payable by an employer to an employee for an unfair dismissal claim, from £68,400 to £72,300.

Under s.34 of the Employment Relations Act 1999, changes must be made to the limits that apply to certain employment tribunal awards, and other amounts payable, in line with changes to the Retail Price Index (RPI).  

From September 2010 to September 2011 the RPI increased 5.6% and to reflect this the maximum amount of a week’s pay which can be used to calculate statutory redundancy payments and awards for unfair dismissal has increased from £400 to £430 per week.   

These new limit applies where the event giving rise to the payment or award takes place on or after 1 February 2012.
